    In re: All Immigration Matters on behalf of XYZ
    Is it okay to sign on something like this? Or am I giving away permission for much more than they need, without knowing!

    Hopefully it is okay to give a permission for "all immigration matters" but wanted to double check, just in case!

    My attorney had the same text in my G28, I asked him the same question. It is fine, nothing to worry about.

    I have my AP approved H1 valid till 2009 but stamp expired. If I marry a non us resident and bring her on H4 and Myself enter in US using AP. Does it mean that my H1 is invalidated?

    Does it mean that my wife's H4 will be invalidated also and she becomes out of status since my H1 is invalidated?

    Or I am completely wrong here?

    I can't file her 485 since my PD is not current and also I cant have h1 restamped cause it takes way long to get it stamped.

    Any Idea?

    and search for a currently pending or approved case. It gives an error. Or is it just me? Can someone check and verify?

    Consult a good lawyer, prepare an appropriate reply based on true situation. If they feel that the request is genuine, they will approve else be prepared for the worst.

    To be frank, i don't think any company like the one you explained even exists! I will be surprised if it does, and if it does I won't wonder if there is no RFE in the current enforcement days from USCIS.

    Sorry to hear about your arrest. Are you staying with her in same house or separate house?. If you live in separate house, why you went there, if you have divorce case is pending.? You need to be careful.

    Is this RFE is generated because of your wife reported your case to USCIS ?
    Do you inform USCIS about your divorce proceedings ?
    You can inform them all details with this RFE. You are victimised and all...
    Gather all evidence to show your innocence.

    Sorry if I posted in the wrong forum,

    I recently changed job. My H1 transfer is not complete yet. Now I have received a very good offer from a different company. Can I transfer my H1 to this company now?

    Yes, you can transfer to any employer and any number of times. At one point, I had 3 approved H1b, but as rule says, I could work only for one at a time :)
    All the H1B's are valid till employer revokes it or it expires on its own.

    The only danger I see in your case is continuous H1 status. If your current employerB goes ahead and cancels H1 petition, you would have worked illegally for the period of time you were with employerB. That can cause problem in your employerC h1 filling and/or future I-485 filling.

    Even if employeeB cancels your petition but employerA hasn't cancel your h1 and it has not expired, then you will not be considered out of status, but you will be considered the one who have worked 'illegally'. This situation might give you h1 approval with employerC, but will have implications in 485 application.

    Its better to wait till you get approval notice for employerB and then switch to employerC based on employerB's approval notice.

    My wife's H1 ends and before it expires she is leaving for home country, there she will apply for h4 to come back on.

    Do we need to file change of status form for her?

    as long as she is in US she is on H1
    in home country She gets H4 stamp..When she enters US again she gets H4 status..

    No need to file another change of status...

    My friend with july-07 filer (I-140 approved in Jan-07) lost H1 in Mar-08 and work on EAD and his company move to new address in May-09. USCIS site visit on Aug-09 to old address for H1-b (one year ext) for his co-worker. His co-worker got letter form USCIS to submit documents in Dec-09 for existance of the Company. Company inform everyone in Nov-09 that it is going out of business and shutting down operation in Dec-09.

    What are the options my friend and his co-worker with (LC/I-140 approved form another company) have??

    Your friend and his co-worker has to find another job in same/similar field as soon as possible and file AC21 with the new employer.

    Middlesex County Superior Court Judge James Hurley ordered firms that register domains and provide hosting services -- GoDaddy Inc., Network Solutions, Comcast Cable Communications Inc. and DiscountASP.Net, to disable the three sites, ITgrunt.com, Endh1b.com, and Guestworkerfraud.com. Facebook Inc. was also ordered to disable ITgrunt's Facebook page.

    The order was made in response to a libel lawsuit filed by IT services and consulting firm Apex Technology Group Inc., based in Edison, N.J. against the three Web sites opposing the H-1B visa program (http://www.h1b.biz/lawyer-attorney-1137085.html). Such attacks on H1B supporters increased last year as the economic situation was gloomy, and prospects for employment were not looking good. Yet, we all know that the H1B program is not the cause of all evil and in fact is a boosting factor in creation of new jobs and opportunities for American workers. Lets hope that the antis will take it easy in 2010, and focus on the real issues at stake.

    My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.

    If she transfer her H1B to new company.
    1. Can she ask for 1 year extension based on her pending labor ? Does she need to wait till the labor gets approved ?
    2. Can she use Premium Processing for H1 transfer?

    Hi,

    I work for Company A. My labor and I-140 has been approved with Company A. I am in my 9th year H1 extn.

    I plan to join Company B using H1 transfer (AC21) and they also help me continue my I-485 by proving similarity of job.

    There is a high likelihood that Company A will revoke my I-140 once I tell them I am leaving to join company B. I am safe with B because H1 transfer and I-485 has been done prior to I-140 revocation.

    However, if I were to join a third Company C using H1 transfer (AC21). Can I do it and also keep my I-485 pending? Please advise.
