Hi,
Recently I have received following mail from USCIS that my case is transferred to NBC. How it's going to effect my case process? What could be possible reason that it transferred to National Benefit Center? IS NBC faster or slow?

Can you please help me figure out how to calculate the eligibility for citizenship. If one married a US citizen. Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?

graduated with a MS in Computer science in may2007.
i applied to another university and got my sevis transferred to do my MBA there.
i have done 11 months 20 days of full time CPT at the previous university(where i did my MS).
am i eligible for another full time CPT at my new university where i have started my MBA (from jan 21st 2008)?
the international students service at my previous university is saying "i am eligible for 12months of full time CPT for every educational level, and i cannot get another 12 months if i do MBA because it is a masters degree too".
please suggest.

yes, they're right. CPT is 12 months max full time and it is 12 months for every educational level.
1.Part-time CPT is 20 hours a week or less. If done during school year, must maintain full time status. It has no effect on OPT.
2.Full-time CPT is more than 20 hours a week. (25 hrs a week is full time). If you do more than 12 months of full-time CPT, you lose your OPT option

Thank you for all the quick replies.
I understand that in october, they might bring up some issues regarding Legal Green Card application.
One of them will be to clear the backlog for those who legally applied for the GC.
Can some kind soul please give me information about this ?
Does this applies to me or does it applies to the Employment based GC or GC application in general ?

I have similar issue and spoke to my Immig Attorney, who advised me as follows-
(1) In order to maintain your resident alien status, you should be in USA more than 181 days, in other words it is adviseable to stay less than 180 days outside USA.
(2) It is adviseable that you return to USA, ASAP, once you get CRIS email that GC approval has been provided.
(3) I believe you are going to use AP. You would prepare your I-94 card at the POA and the POA officer would ask you where you are employed before putting stamp on I-94. Be prepared to answer that question. Most likely 99%, the POE IO will not ask any proof. However, it is adviseable to have a current job (sort of Employment Verification Letter) and leave letter approval.

I'm not a lawyer but my Mom was in the same situation accept she had GC back in the 70's and after that she moved to India and then used visitors visa to travel back and forth (couldn't travel every year) - My understanding is that once you use visitors visa to enter the country you automatically abandon your perm resident status (even though she never physically surrendered the GC).
She is now in the process of getting another 10 year visitor visa stamp, what I plan to do after that (through a lawyer) is request for info on her existing file under "right to know" laws, that will give information on her current state of GC... and then take it from there. Since I now have GC I'm thinking it would be easier to sponsor her in a few years then going through the process of reviving her GC (if thats even possible).
Hope this helps a little! if you plan to get info on her file make sure she has a good amount of time left on her visitors visa... so she can travel back and forth.

I am July 2 filer and I called yesterday and they gave me this BAD news. They said "Other reasons". I can't think of what they could be. They said they are sending application back which I did not receive yet.

No, you do not need to file I485 for child, who is a us citizen. No medicals exam required, since they get everything here after birth.
But you have to mention child details on your I485.

Hello!
My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
If I remember correctly, you are allowed to work for 240 days from the receipt date while your case is pending. If the approval does not come within 240 days, you have to stop working and wait for the approval. You are NOT considered out-of-status as long as your petition was filed before the current H1 expired.

I am on H1 (Has EAD but never used it), my wife is on H4 and also she has H4 stamping till Feb 2010, She got EAD and and also got SSN. But she never worked on EAD. Now she want to travel to India

You don't say when the change of status (COS) to H-1B took effect. I assume it was 10/1/09, if you were subject to the H-1B cap. If you have not worked for the H-1B employer, then you are unfortunately out of status now and any COS would probably be denied. If you have a valid H-4 visa, you could leave the US and re-enter showing the H-4 visa to return to H-4 status.

I don't think one can open a account from india in US bank. However i had visited a website which says that anyone in the world can do business from USA. I tried it but did not.
I am in H1B and i opened a business account in USA. The procedure is to get a fititcious businesss name from the citi and open a account in any of the banks. Later apply for a business license from the city. Every year you will have to file tax return (i do it on the month of december). It is very easy and consulars help over there. Additionally you have a advantage to talk to any of the SCORE/SBA members and improve your business.
Regarding opening a business account, Wells fargo charges $10/- every month and later if you talk to them about low activity account they will charge you $8/- per month. Citibank needs a lot of information and they charge $10/- a month. I had avoided citibank after spending 3 hours interacting with the teller. The best is Washington Mutual (which is Chase now). there is no charge and i think they need atleast one transaction every year.

My employer had sent my H-1 application in May first week, but he didn't even receive the EAC number till last week. So, he re-filed my H-1, this time by premium processing and its been a week, and still no EAC number. Is anyone having the same delays as me? If so, is there any way to contact someone or get the status of my application? Looking for an urgent response. Thanks,
