My wife did call the National Customer Service Center and opened a service request too. But we have not heard anything yet. We tried getting an infopass appointment but none is available in our area. We will try it again tomorrow. I am kind of surprised how this can happen because in the USCIS database, approval of derivative application requires a check on primary application approval first. This is what I have been told by another lawyer.

I am in the same situation.. send docs to Dallas lockbox.
Applied for EAD renewal and documents reached on May7th.. checks not cased yet. I think the whole lockbox is creating the delays but one they get to your application it is relatively quick.
Do let me know when your checks are cased.

I have EAD that is valid till Dec 2007, but I will be on leave of absence overseas from mid Feb to October , 2007. ( my Travel parole also expires in Dec 07)
My I-485 is pending with PD Jul 2002 ( EB3 india)
Will this time off destroy my Green Card application?
( does the EAD lose its validity if I stay overseas for >6 months and will this impact my GC process?)

My friend lost her green card while she was on vacation in China. She got a temporary green card to travel in a week or so which facilitated her entry into US and once she reached here, she just applied for another green card claiming the initial one as lost. There were no issues except the travel delay and the monetary loss.

Send your petition to USCIS Ombudsman. This is a classic case of USCIS incompetence. They have all the documents and yet they pester you to provide the details.

My AP was approved Nov 16. Email from USCIS said approval notice sent. I had to travel Dec 4th. When my lawyer contacted USCIS on Nov 25th, USCIS said they were in the process of printing the form. My lawyer suggested trying for the emergency AP. The Baltimore office says walk-ins not allowed. My travel was postponed for other reasons. Double check that USCIS actually mailed the notices to you.

I can't suggest anything on this. Its upto you. I guess you can wait till the end of this month. Sometimes they approve without sending FP notice as per some posts on immigration forums. you never know it is USCIS.... good luck..

We hired a scientist with O-1 visa two year ago (company provided all the documents). This scientist applied green card (EB-1) last year. This week he recived a letter rejecting his application. The reason is not about his personal qualification but is about the company. Letter says company had no publications although we provided the copies of US patent applications.
We are a small R&D company with no budget for and work plan for any kind paper writing. Can INS use "without publication" as the only reason to turn down the EB-1 type application?
This scientist is very important to our company. What shoul we do to let INS reconsider this decision?

Dear Attorney and other friends,
Please give me some advice on my situation,
My mother had green card through my sister who is US Citizen. four years ago my mother wen to India and did not came back. after 6 years she again came back on visitors visa.
we want to renew her greencard.
Please advise if it is possible of we have to start new process?

Your friend has to wait till he gets his citizenship. A GC holder can only sponsor someone to visit, but can't sponsor another person for GC. A citizen surely can. I heard that an immigrant could apply to USCIS to grant spouse also a GC based on hardship grounds. But I would not bet on largesse of USCIS. It is a headache dealing with bureaucrats, lawyers and appeals.
If your friend had a traditional marriage (Church/Temple/Mosque etc ...) and not registered it or just an engagement, it should be fine. There is a risk that your friend's (would-be) wife might be denied entry into USA based on marriage to an immigrant. F-1 VISA holders are not supposed to have immigration intent.
Once his (would-be) wife lands here, your friend should have a registered marriage in USA. She has to continue on F-1 VISA till he gets his Citizenship.
There was a V VISA provision which expired as of December 2001 or 2000. This would have allowed GC holders to bring their spouses on V VISA. Ask your friend to join the groups which campaign for this provision. :)

Just wanted to find out if you were aware if it makes any difference as to where you get your receipt from-- with respect to making an appointment(location).
What I mean is, would it be OK to get receipt from a HDFC branch in Mumbai, if you were going to make an appointment with New Delhi Embassy ?
Any experiences..?

It is common to all consulates and Embassy, it can be used anywhere, it will be drawn in favour of US Embassy, New Delhi. HDFC bank will issue you what they have to give, so don't worry.

TSC is not processing most EB3 I485. This is not supposed to be revealed publicly. It is wrong, so that's why I'm speaking out.

One of my friends travelled in the same situations. No questions asked at port of entry(Chicago). He was little worried like you and was short of time to get the visa stamped but it went fine.

I thought this will be a useful information to everyone.
My Case,
04/18/2008 -Applied EAD online
06/19/2008 -Status changes to "Approved" but no Notice sent.
07/20/2008 -Waited for 30 Days and called USCIS to open a Service Request.
07/24/2008 - Received EAD at home.
08/26/2008 - Received the letter from USCIS saying we have sent you the card but never received back or delivered to you hence concluding it is considered lost and if you need it, Please file for EAD again.
I called USCIS, Customer server rep said take an Infopass appointment to make sure it is valid.
Took the appointment, went USCIS on 09/10/2008.
Officer takes a look and tells me "Obviuosly you have EAD in your possession and unless you made it up on a color Laser printer, It is my fault that I have provided wrong information to USCIS and not waited for 30 days as I should have and I am there to pick up a fight with USCIS,bla bla bbla"
I remained very calm knowing he does not like his job but have to do it.
He is rude and clueless at the most why I am there. My first experience with USCIS, I dont think I want to go to their office again.
Finally conclusion he tell me "Once EAD is issued it remains VALID until you notify USCIS that it is lost or stolen or tempered with, USCIS DOES NOT take any proactive actions on EADs that are issued. Hence NO action is neccessary at this time"
Moral of Story is DO NOT go to USCIS if you receive such type of letter from USCIS after opening a service request for EAD.
I wasted a good amount of time and money just to take this BS.
