Seeing the enthusiasm of all the people on this message board, I would like to request IV Core to co-ordinate rallies in various cities by doing the following:
1. Facilitate a common date for all rallies through consensus
2. Facilitate the development of a common theme through consensus
3. Facilitate an official statement on our position on "employers that abuse the immigration system"
I propose that the San Jose rally organizers should act as advisors to other local chapters since they did a wonderful job organizing the rally.

If you had an approved H1B last, that means that you already are on H1B status as of Oct 01 2006. You can continue to work in US on H1B and get it transfered also. Only when you go out of country then you will have to get new H1B stamped. I also had L1 to H1 change.
The visa officer will surely ask you that "why did you change your status from L1 to H1" So be prepared with a good answer for that.

There is no issue if your wife is the derivative applicant and gets her EAD through you. You can also start but it is more complicated since your business has to be doing excatly the same thing as your labor application. Also, i think you should get lawyers advice if you are starting it. There is no complication for your wife to start a business.

Comprehensive immigration under Democrats did not have anything for us as high skilled immigrants anyways. With a decrease in EB visa numbers in fact it was anti high skilled immigrants.
In fact the IV community was rejoicing when it fell through in the senate.
Now that CIR has been pushed ahead, IV can easily put forth the perspective of having a legislation specifically for the skilled community.
Lets look at it this way, CIR was an excuse used by a lot of politicians to avoid solving issues faced by the highly skilled community; with its demise they have one less excuse.
In fact the IV community was rejoicing when it fell through in the senate.

If I were you, I would just do a little search in the forum and close this thread. There was an extensive discussion on this very topic for days and the thread had to be eventually closed because it was taking ugly turns. Let's not go that route again. Hi,
My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

She does not need to do anything but get a job, fill form I-9 and start working again. She is in a period of authorized stay since her I-485 is pending. I don't think it's even necessary to apply H4 for her.

if so, will the priority date be same or it will be new once converted to F1 category.
IT WILL STAY THE SAME.
2. Can I apply for both family based and employment based in parallel?
YES, THIS IS COMMON.
if it is not possible which path should I select? Will the employment based GC will be faster of family based?
FAMILY-BASED AS THE UNMARRIED CHILD OF A US CITIZEN IS PROBABLY FASTER, ASSUMING YOU ARE FROM INDIA.
